By accessing or using our website, services, or purchasing our products (collectively, the "Services"), you agree to be bound by these Terms of Service. Please read them carefully. These terms are governed by the provisions of the Information Technology Act, 2000, the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, and the Consumer Protection (E-Commerce) Rules, 2020.
1. General Conditions & Legal Liability
We reserve the right to refuse service to anyone for any reason at any time. You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service, use of the Service, or access to the Service without our express written permission. To the maximum extent permitted by applicable law, Ghewal Tea Industries shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from (a) your access to or use of or inability to access or use the Services; (b) any conduct or content of any third party on the Services; or (c) unauthorized access, use, or alteration of your transmissions or content.
2. Accuracy, Completeness, and Timeliness of Information
We are not responsible if information made available on this site is not accurate, complete, or current. The material on this site is provided for general information only and should not be relied upon or used as the sole basis for making decisions without consulting primary, more accurate, more complete, or more timely sources of information. Any reliance on the material on this site is at your own risk. Prices for our products are subject to change without notice. 3. Return & Refund Policy (Strict 3-Day Window)
Pursuant to the Consumer Protection (E-Commerce) Rules, 2020, we maintain a strict 3-Days Return Policy. You may initiate a return within exactly three (3) calendar days from the date of delivery. To be eligible for a return, your item must be unused, sealed, and in the same condition that you received it. It must also be in the original packaging. Perishable goods such as tea leaves cannot be returned if the airtight seal has been broken or tampered with. If 3 days have passed since your purchase delivery, unfortunately, we cannot offer you a refund or exchange under any circumstances. You agree that this 3-day limitation is reasonable and constitutes an express waiver of any extended return periods.
4. Dispute Resolution & Governing Law
Any disputes, controversies, or claims arising out of or relating to these Terms of Service or the breach, termination, or invalidity thereof, shall be settled by arbitration in accordance with the Arbitration and Conciliation Act, 1996. The seat and venue of arbitration shall be Mehsana, Gujarat, India. The language of arbitration shall be English. These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of India, subject exclusively to the jurisdiction of the courts in Mehsana, Gujarat. By using this site, you expressly waive the right to participate in a class-action lawsuit or class-wide arbitration.
5. Indemnification
You agree to indemnify, defend and hold harmless Ghewal Tea Industries and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.
